Sub:   A Big Debate on  A.P. SC/ST SUB-PLAN  ACT, 2013, Misuse and Diversion

of Sub-Plan Funds  and Introducting of  SC, ST Special Plan Act at

National level  -Representatives of all the state level SC/ST organisations

and others- Resolved – To  Review  the  Act No.1 of 2013  and make

necessary  amendments of   “ The   Andhra  Pradesh  Scheduled Castes

Sub-Plan  and  Tribal Sub-Plan”  ( Planning  Allocation  and Utilization of

Financial  Resources)   dated  24-01-2013 – Regarding.

We organised  a Big  Debate  on  A.P. SC/ST SUB-PLAN  ACT, 2013, Misuse and Diversion of Sub-Plan Funds  and Introducting of  SC, ST Special Plan Act at National Level   with the   Representatives of all the State level SC/ST organisations, Politicians and Activists  held on 30th  November, 2013, at  Ravindra Bharathi, Hyderabad.

All the Participants  took part in the BIG DEBATE express their view  welcoming the Act and also critised the way the Act was enacted without   completeness against the  the main principles and  concept behind the Scheduled Caste Sub-Plan and Scheduled Tribes Sub-Plan with reference to the various advisories /guidelines  issued from time to time  by the office of  Prime Minister, Ministry of Social Justice & Empowerment, Ministry of  State for Planning and   Planning Commission of India   and the recommendations of  the National Advisory Council  for ensuring the effective implementation of  SCSP/TSP. The Constituted Cabinet Sub-committee  headed by Shri C.Damodara Rajanarsimha, Hon’ble Deputy Chief Minister  along with the eight Cabinet Ministers as its Members of committee, in their  Draft Report   recommendations and suggestion made by them   not considered  as  the   part of  Act  by the Government  while enacted  the Act.

We are appreciate  the Government of  Andhra Pradesh in enacted “ The Andhra Pradesh Scheduled Castes Sub-Plan and Tribal Sub-Plan   (Planning Allocation and Utilization of Financial  Resources) Act, 2013,  Act No.1 of 2013 dated  24-01-2013 for the welfare and development   of  the Scheduled Castes and Scheduled Tribes in all the sectors in the State of  Andhra Pradesh and it is first in kind in the country.

But, at  the same time the Government  failed to include main object of the original  “Special Component Plan for Scheduled Castes and Scheduled Tribes ” (SCP for SC/ST)   in true sense not in theory or methodology  but it must be in practically.  The recommendation and suggestion  made by the  Cabinet Sub-Committee on the SCSP and the TSP in A.P., Consultations Committee) in their Draft Report  submitted to the Govt of  A.P. in August, 2012  not  considered by the Government  is not  correct.

The main principles and  concept behind the Scheduled Caste Sub-Plan and Scheduled Tribes Sub-Plan with reference to the various advisories /guidelines  issued from time to time  by the office of  Prime Minister, Ministry of Social Justice & Empowerment, Ministry of  State for Planning and   Planning Commission of India   and the recommendations of  the National Advisory Council  for ensuring  the effective implementation of  SCSP/TSP.

The  aim, object and main motto  of  this  Act is to ensure, accelerated development of Scheduled Castes (SC) and Scheduled Tribes (ST) with emphasis on achieving equality in the next ten years focusing on economic educational and human development along with ensuring security social dignity and promoting equity among Scheduled Castes and the Scheduled Tribes, by earmarking  a   portion, in proportion to population of Scheduled Castes and Scheduled Tribes in the State, of the total  plan outlay of the State of Andhra Pradesh as the outlay of the Scheduled Castes Sub-Plan (SCSP)/Tribal Sub-Plan(TSP) of the State.   The Act also envisages setting up the  Scheduled Castes Sub-Plan(SCSP)/Tribal Sub-Plan(TSP) of the State.   The Act also envisages setting up of a State Council for Development of Scheduled Castes and  Scheduled Tribes, suggest measures for planning and implementation of schemes and for approving the Scheduled Castes Sub-Plan (SCSP/Tribal Sub-Plan(TSP) of the Departments.

As per the G.O.Rt.No.1640 dated 13-4-2012, Cabinet Sub –Committee headed by Shri C.Damodara Rajanarsimha,  Hon’ble Deputy Chief Minister as Chairman and eight Cabinet Ministers as the  member of  the Committee constituted by the Government.   The Cabinet Sub-Committee comprehensive examined the matter relating to the implementation of the Scheduled Castes Sub Plan and the Tribals Sub Plan in Andhra Pradesh in consultation with all the sections of the community peoples and their organisations heads by organising the meetings in the District Headquarters and other places in the state and they do justification to their job perfectly.  But the unfortunately  the Government  not consider their recommendations and suggestion made in their Draft Report  it is nothing but Government  failed to  give  completeness original  of   “Special  Component Plan  for  Scheduled Castes &  Tribal Sub Plan”.

Cabinet Sub –Committee comprehensively made studied with reference to the various advisories /guidelines  issued from time to time  by the office of  Prime Minister, Ministry of Social Justice & Empowerment, Ministry of  State for Planning and   Planning Commission of India   and the recommendations of  the National Advisory Council and also examined the implementation of SCSP/TSP in  some of  the States  for ensuring the effective implementation of  SCSP/TSP  elaborately discussed and highlighted all the best proposals, solutions and action plans as key note on very aspects  and suggested and made  recommendation  in their Draft  Report.

Whereas the Government of  Andhra Pradesh while enacted “ The Andhra Pradesh Scheduled Castes Sub-Plan and Tribal Sub-Plan        ( Planning Allocation and Utilization of Financial  Resources) Act, 2013,  Act No.1 of 2013 dated  24-01-2013 not  followed above said advisories/guidelines issued by  the above  said officials.  The main provisions and sections are against the main object of the Act.  The Object of the Act   is  defeated for the provisions of the Act.

 All the Participate  in the BIG DEBATE  unanimously passed following resolution and  resolved as under:

“The Andhra Pradesh Scheduled Castes Sub-Plan and Tribal Sub-Plan ( Planning Allocation and Utilization of Financial  Resources) Act, 2013,  Act No.1 of 2013 dated  24-01-2013  should make necessary commission, omission  amendments  to  strength the Act  as follows

SOME OF  EXAMPLES  IN DEFICIENCIES  IN  THE  ACT  WHILE  ENACTED

CHAPTER-1

General Schemes is equal to means, scheme included in Annual Plan of  the Department  which benefit all social groups including Schedule Castes and Scheduled  Tribes.

 Objectional  Point  :  Once it is deemed as a General Scheme, the Budget earmarked for the Scheduled and Scheduled Tribes should not be included in the General Schemes otherwise the purpose of the Act  is defeated.

CHAPTER-2

Clause-7   :  Obligation to cover Scheduled Caste and Scheduled Tribes in General Schemes.

Objectional Point:  It is against the principles of  the “ Special Component  Plan for  Scheduled  Caste  and  Tribal  Sub Plan”

  CHAPTER – 3

Clause 11 (  c  ) : With regard to General  Schemes included in the Sub-Plan benefiting the Schedule Castes and Scheduled Tribes along with  others.   Once it is implemented  along with others, the budget allocated in the sub-plan should not be utilized.

Clause 11 (  d  ) :   With regard to non-divisible infrastructural works like Major Irrigation Medium Irrigation, C.A., D.A., Flood Control and Drainage, R & B, APSRTC, Medical Education, Infrastructure etc., the said non-divisible infrastructure do not ensure direct  benefits to the individuals or families of  Scheduled   Caste and Scheduled Tribes.

RECOMMEND  that the Schemes  should be included under  SCSP, TSP that ensure direct benefits to the individual or families belongs to   Scheduled   Caste and  Scheduled Tribes.

RECOMMENDATIONS OF NATIONAL ADVISORY COUNCIL (NAC) COMMUNICATED TO PM BY SMT. SONIA  GANDHI, CHAIRPERSON, NAC  ON  20th  DECEMBER, 2011

To achieve this objective, the National Advisory Council recommends that planning and implementation of SCSP/TSP needs to be reformed as  to realize the objective of bridging he gaps on development indicators, between SC/STs and the rest of the  population, in a time-bound manner.  The key principles for the reform agenda recommended by the National Advisory Council to the Government  are:

The  some  of  the  key  principles for the reforms :

f.   SCHEDULED CASTES SUB-PLAN AND TRIBES SUB-PLAN  Funds to be made non-lapsable and non divertible.

g.  SCHEDULED CASTES SUB-PLAN AND  TRIBES SUB-PLAN Funds to be channelized only to such schemes where tangible benefits accrue to SCHEDULED CASTES AND SCHEDULED TRIBES  individuals  or households or groups or localities.

h.  Schemes taken up under SCSP/TSP should be closely monitored and the information should be hosted in public domain so as to enable anyone to track every scheme, every household and every rupee spent under the scheme.  Social auditing of the schemes should also be facilitated.

 

  1. The original name viz. “Special Component Plan for Scheduled Castes”     (SCP) which was in vogue from 1978 till 2006 should be restored.

The above guidelines may be strictly followed by all the concern

OTHER  ASPECTS  MAY  BE CONSIDER   BY  THE  GOVERNMENT

DRAFT  REPORT OF THE CABINET SUB COMMITTEE ON SCHEDULED CASTE SUB-PLAN (SCSP)  AND TRIBAL SUB-PLAN  (TSP)  RECOMMENDS AND  SUGGESTIONS MADE  BY  THEM   NOT  A  PART  OF  THE  ACT  THAT  SHOULD BE PART ACT  OTHERWISE   THE PURPOSE OF CONSTITUTION OF CABINET SUB-COMMITTEE  AND EFFORTS MADE BY THEM IN SUBMITTING REPORT  IN CONSULTING WITH THE BLOCK LEVEL SC/ST PEOPLE TO STATE LEVEL SC/ST  ORGANISATIONS BY ORGANISING  THE   MEETING  IN  THE  ENTIRE   THE  STATE  IS DEFEATED.  A COPY OF SUMMARY OF THE REPORT AND THE  RECOMMENDATIONS  ENCLOSED  HEREWITH. 

NO RULES FRAMES  BY THE GOVERNMENT  TO THE  ACT  FOR FACILITATING SMOOTH  IMPLEMENTATION  OF  THE  PROVISIONS  OF  THE  ACT. GOVERNMENT  MAY TAKE STEPS TO FRAME RULES TO THE ACT IMMEDIATELY.

EVEN  AFTER THE COMMENCEMENT OF THIS  ACT ALSO THE SAME SCSP/TSP FUNDS DIVERSION TO THE NON-SC ST COMMUNITY  FIELDS.    THE PURPOSE  OF  THE  ACT AND VISION  IS  DEFEATED.( ENCLOSED  LIST  OF DEPARTMENTS WISE EXPENDITURE UPTO NOVEMBER, 2013 RECEIVED INFORMATION THROUGH THE RTI Act – DIVERSION OF  FUND  MARKED WITH  CIRCLE )

FUNDS DIVERSION  TO THE NON-SC ST COMMUNITY FIELDS RETAINED  THOSE FUNDS  FROM  CONCERNED  DEPARTMENT  FUNDS AND REFUND TO THE SC & ST PLAN.

THE  SUCH  RESPONSIBILITY  AUTHORITIES  CONCERN WHO ACTS AGAINST THE SC & ST INTEREST  SHALL BE PUNISH  FOR SUCH ACTS  UNDER SC/ST

ATROCITES  ACT AND OTHER CRIMINAL MAJOR ACTS SO  THAT  AUTHORITIES ACT PROMPTLY TO  ENSURE  PURPOSE  OF THE  ACT  TRULY  IMPLEMENTED.

NO FUNDS  RELEASE TO THE SCHEMES THAT   DIRECTLY   BENEFITS TO THE  SC/ST COMMUNITIES  WHICH AGAINST  THE  BASIC PRINCIPLES  OF  THE  ACT.   MORE  PREFERENCE   GIVEN  TO THOSE  SCHEMES WHICH  BENEFITS TO THE SC & ST.

NO REPRESENTATION OF  THE SC/ST COMMUNITY  MEMBERS i.e. NON-OFFICIAL MEMBERS, CONSISTING OF THREE MEMBERS FROM SC COMMUNITY AND TWO MEMBERS FROM ST COMMUNITY IN  STATE COUNCIL FOR DEVELOPMENT OF SCHEDULED CASTES AND SCHEDULED TRIBES.   TWO TIMES  MEETING  HELD BY THE GOVERNMENT WITHOUT  REPRESENTATION OF SC & ST MEMBERS.  IMMEDIATELY  TO INCLUDE  THEM  IN THE COUNCIL.

INTRODUCING  OF  SC, ST  SPECIAL  PLAN  ACT   IN THE CENTRAL SHOULD ALSO TAKE ALL THE CAUTIONS STEPS  WHILE  INTRODUCING THE ACT IN THE NATIONAL LEVEL  FOLLOWED  BY  ALL  THE  ABOVE   DISCUSSED THE  ISSUES  AND SUGGESTIONS   AND  RECOMMENDATION   IN THE PROTECTING THE INTEREST  OF  THE  SC  &  ST IN THE  NATIONAL   AS ACT  TO  ROLE  MODEL  TO    ALL THE  STATES  GOV0RNMENT AND UNION TERRITORIES.”

Therefore,  WE  DEMAND TO THE GOVERNMENT OF ANDHRA PRADESH TO MAKE NECESSARY COMMISSIONS, OMMISSIONS AND AMENDMENTS AS PER THE RESOLUTIONS PASSED IN THE BIG  DEBATE  to call for high level meeting alongwith the   representatives of  SC & ST  organisations and review  the  Act otherwise  we have to take steps to  the protect  SC/ST Funds and to safeguard the rights and  interest of  the Scheduled Castes  and Scheduled Tribes  communities peoples in the State.

Further, we request your goodself  to kindly intimate  the action taken by your office  in  this  regard  and  oblige.
